Discrimination occurs when one person is treated differently or less favorably for some reason, such as race, color, gender, age, disability, pregnancy, or sexual orientation. Employers cannot take an “adverse employment action” against an employee for a discriminatory reason. An adverse employment action can include, for example, termination, demotion, failure to promote, a reduction in work hours, unfavorable job assignments, and involuntary transfers. Usually, discrimination is also accompanied by a hostile work environment and retaliation.
